These Terms of Service apply to your use of ev-mart.com.au and purchases made from EV-Mart. By using this website or placing an order, you agree to these terms and the policies linked at checkout.

About EV-Mart

EV-Mart sells electric vehicle accessories to customers in Australia. References to “EV-Mart”, “we”, “us” and “our” refer to the operator of this store.

Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order.

Product Information and Vehicle Compatibility

We take reasonable care to describe products accurately. Colours, measurements and appearance may vary slightly because of screen settings, manufacturing updates or reasonable measurement tolerances.

For vehicle-specific accessories, please check the vehicle brand, model, variant, model year, seating configuration and right-hand-drive compatibility shown on the product page before ordering. Contact us before purchase if compatibility is unclear.

Your responsibility to check supplied vehicle details does not remove EV-Mart’s responsibility to provide accurate descriptions and does not limit any rights under the Australian Consumer Law.

Prices, Taxes and Shipping

Prices are displayed in Australian dollars unless stated otherwise. For orders delivered to Australia, applicable duties and taxes are included in the amount charged by EV-Mart. Shipping charges, including any applicable remote-area charge, are shown or confirmed before dispatch.

Shipping and delivery are governed by our Shipping Policy.

Orders and Acceptance

Placing an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not prevent us from cancelling and refunding an order where a product is unavailable, a price or description contains a genuine error, payment is not authorised, or we cannot deliver to the supplied address.

If we cancel an order before supply, amounts paid for the cancelled items will be refunded.

Payment

You must provide complete and accurate billing and payment information. Payment processing may be provided by Shopify, PayPal or another payment provider and may be subject to that provider’s terms and privacy practices.

Order Changes and Cancellations

Contact us promptly to request a change or cancellation. We will try to assist, but changes or cancellation cannot be guaranteed once processing or dispatch has started.

Returns, Refunds and Consumer Guarantees

Returns and refunds are governed by our Returns & Refunds Policy.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Website Use

You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape content in breach of applicable law, or use the website for fraudulent or unlawful activity.

Intellectual Property

Unless otherwise stated, website text, graphics, branding and original content are owned by or licensed to EV-Mart. They may not be reproduced or commercially used without permission, except as permitted by law.

Liability

To the extent permitted by law, EV-Mart is not liable for indirect or consequential loss that was not reasonably foreseeable. Nothing in this section limits liability or remedies that cannot lawfully be limited, including rights under the Australian Consumer Law.

Changes to These Terms

We may update these terms by publishing a revised version on the website. Changes apply prospectively and do not alter the terms applicable to an order already placed unless required by law or agreed with the customer.

Governing Law

These terms are governed by the laws of Victoria, Australia. Nothing in this clause prevents a consumer from relying on rights available under applicable Australian law.
